Rules and Regulations

These are the rules of the發表原創歌曲 (“O.S.Upload”) organized by the i-CABLE Entertainment Limited (“iEL”). By entering this O.S.Upload, entrants agree to be bound by these rules.

Eligibility

1. All persons are eligible to enter the O.S.Upload except that: (a) the O.S.Upload is not open to employees and their immediate families of iEL and its group companies. (b) entrants aged under 18 must obtain consent from their parents or guardians prior to entering the O.S.Upload. iEL may require such entrants to provide evidence of the required consent, and disqualify the relevant entrants if they fail to produce same.

Entries

2. An entry must be in the form of a complete song with music and associated lyrics of any language. Length of each entry must not exceed [5] minutes.     3. Each entrant must ensure and hereby warrants that his/her entry: (a) is originated by the entrant and does not infringe the copyrights, performer's rights, moral rights and other rights of third parties. (b) does not contain defamatory, indecent or obscene material.     4. Each entrant may submit one or more than one entry. All entries must be submitted via www.i-cable.com/cablemusic     5. All entries must not have been commercially released anywhere in the world.     6. Entries are submitted at an entrant's own risk and expense. iEL is not liable to pay or reimburse any expense incurred in entering the O.S.Upload. iEL has no obligation to return to the entrant any entry, including that consisting of artistic or other material. Each entrant is therefore advised to keep a copy of his/her entry.

Rights and Consents

7. Each entrant hereby grants iEL a royalty-free and non-exclusive licence to: (a) record, reproduce, perform, broadcast, include in any cable programme service, issue, make available to the public via the Internet and mobile devices and archive his/her entry whether on a standalone basis or together with other works (including films made for the production of “music videos”); (b) edit or excerpt the entry for time-segment, promotional or censorship purposes; (c) arrange any person to perform and record the entry; and (d) authorize any persons to do any of the aforesaid, during the entire copyright protection period of the relevant entry throughout the world.     8. Each entrant hereby consents: (a) that iEL has unlimited rights to broadcast, rebroadcast, include in any cable programme service, transmit via the Internet and mobile devices, show in public or otherwise exploit any television programmes, audio productions, audiovisual productions or any other materials in which his/her entry has been incorporated anywhere in the world at any time. (b) to waive all moral rights in relation to his/her entry. (Despite the aforesaid, iEL will identify the entrant as the author of his/her entry when using his/her entry). (c) to provide the score of his/her entry upon iEL's request. (d) to be filmed and recorded by iEL upon iEL's reO.S.Upload, and that iEL is entitled use the name(s), photographs and audiovisual recordings of the entrant in any publicity. (e) not to participate in any competition or event in Hong Kong whose nature is identical or similar to that of the O.S.Upload, prior to the end of the O.S.Upload. (f) to sign an assignment of the entry to iEL (or its delegate) upon iEL's request with such terms and conditions to be mutually agreed upon.

General

9. iEL has the right to reject any entry at its discretion, and to disqualify any entrant if the entrant has breached any of these rules.     10. Personal data of the entrants (and, where applicable, their parents/ guardians) will be used for the purposes of the O.S.Upload. iEL will destroy all used personal data within a reasonable time.     11. These rules are governed by and interpreted in accordance with the Hong Kong law.
